1)One who journeyed through a sea  and arrives at  his destination safely recites Birchas HaGomel. (Shulchan Aruch Siman 219:1)

 

This only applies to a sea or ocean (i.e. where the large waves and other elements can be dangerous) and not to rivers and other calm bodies of water. (See Biur Halacha Siman 219 Dibur Hamaschil Yordei)

 

The Bracha is only recited after arriving on dry land, even if something dangerous transpired while the ship is still en route from which they were saved. (Kaf HaChaim Siman 219:4 and Mishna Berura 219:1)

 

2) One who travels through an underwater tunnel (such as the tunnel connecting England and France) is not considered to have journeyed through the sea and does not recite Birchas HaGomel upon leaving the tunnel. (Shu"t Shevet Haleivi Vol. 9 Siman 72 and Shu"t L'Horos Nosson Vol. 7 Siman 10. See also Shu"t Minchas Yitzchak Vol. 4 Siman 11)

Similarly, one who takes a ferry ride or otherwise is on a ship for a short period of time and not for an extended journey, does not recite Birchas HaGomel upon getting off the ship, unless the ship was in actual danger at some point in the ride.

Today's days when ship travel is basically nonexistent, A Rav should be consulted with the specific details of any ship ride to determine if Birchas HaGomel is halachically required.

Reader's Question:

 

If one had to Daven over Shmoneh Esrei because they forgot Yaleh V'Yavo [or any other insertion that needed to be said] do you count the extra 19 brochos towards the count of the 100 Brachos that need to be said each day?

 

 

Answer:

 

  

The second, valid , Shemona Esrei is definitely counted. The question is if the original Shemona Esrei is counted.

 

The Poskim debate this.

 

They base it on the machlokes (which we recently discussed) if  one omitted something from Shemona Esrei and thus needs Tashlumin, is the Tashlumin coming to  give him just the part he missed, or is the whole Shemona Esrei invalid, and thus the Tashlumin is necessary for the entire Shemona Esrei.

 

If its like the first opinion, then the first Shemona Esrei was valid as far as the 100 brachos are concerned. If it's like the second opinion that the entire Shemona Esrei was invalid, most likely those Brachos will not count toward the 100.

 

The Chazon Ish  was said to have ruled that indeed a shemona esrei that needed to be repeated was still counted toward the 100 brachos. (brought in Ma'aseh Ish page 88)

Halachos for Erev Shabbos Kodesh

 

1) We learned that one who was in a dangerous situation and was saved recites Birchas HaGomel. We will now discuss some various different "situations" and their Halachic status.

 

The Poskim point out that one needn't necessarily be in actual danger, rather even if one was in a place or situation where it is common to encounter danger, if he passed through and was never presented with any actual danger the Bracha is still recited. (See Biur Halacha Siman 219 Dibur Hamaschil Yordei HaYam where he cites an example of one who travels over calm waters of a sea would recite Gomel, because it is common to encounter dangerous waves etc. in the place he crossed. See also Shu"t Har Tzvi Siman 113)

 

2) One who was in a serious car collision that potentially could have caused death, and survived, recites Birchas HaGomel (Based on Shulchan Aruch Siman 219:9 that one who had a "collision" with a bull recites Gomel)

 

One who was "almost" in a serious collision and at the last moment averted the danger, does not recite Birchas HaGomel (See Shu"t Teshuvos V'Hanhagos Vol.2 Siman 136. He writes there also in the name of Rav Yaakov Kamenetsky Zatzal, that in any case where one was in or near danger, where the Halacha is that one does not recite Birchas HaGomel, still it is important to thank Hashem and say various Tefilos of Hoda'ah. See also Halichos Shlomo Perek 23:1, Shu"t Igros Moshe Orach Chaim   Vol. 2 Siman 49 and Shu"t Tzitz Eliezer Vol. 18 Siman 22)

 

 

One who was in a war zone and returned to safety unscathed recites Birchas HaGomel. (See Shu" t Shevet Haleivi Vol. 5 Siman 24:2)

 

Soldiers who are in combat and are saved from an actual danger recite Birchas HaGomel, even if they will still remain in that war zone. (See Shu"t Shevet Haleivi Vol.  9 Siman 45 at length for other details that pertain to soldiers in and out of war zones. See also Shu"t L'Horos Nosson Vol. 11 Siman 12)

 

 

Halachos for Shabbos Kodesh

 

1) One who was kidnapped by terrorists or other dangerous beings, and was released, recites Birchas HaGomel (See Shu"t Yechaveh Da'as Vol. 2 Siman 25)

 

A caravan of vehicles that was traveling through enemy territory where  stones were thrown at them with the intent to kill, if one vehicle was damaged and in danger, the members of all the vehicles in the caravan, even the ones that were not damaged but could have been, recite Birchas HaGomel. (Shu"t L'Horos Nosson Vol. 11 Siman 13)

 

If one was held up by an armed robber who threatened to kill him unless he handed over money, since his life was in danger, he recites Birchas HaGomel upon getting out of the situation alive. (Shu"t Va'Yan Dovid Siman 36)

 

 

2) One who was in prison [for an extended period of time], if it was for a matter that could have resulted in a death sentence, according to all Poskim he recites Birchas HaGomel upon being released.

 

If he was incarcerated for other reasons, and was never in danger of being executed, it is a big dispute amongst the Poskim if Birchas HaGomel is recited upon being released, and according to many Poskim the Bracha should thus be recited without Shem U'malchus, especially in today's society where execution is never carried out for anything other than capital crimes, and even then very rarely. (See Biur Halacha Siman 219 Dibur Hamaschil Chavush. See also Kaf HaChaim 219:11, Aruch HaShulchan 219:5,  Kitzur Shulchan Aruch Siman 61:1 and Chayei  Adam Klal 65:6. I'm not sure but i remember learning that you do not have to use a utensil when you wash for Neegel Vasser in the morning and that  the only time when it is a must is when you are washing for bread. Is that correct?

 

 I remember learning it in the Kitzur Shulchan Aruch.

 
 

Answer:

 

 
 

There is an opinion in the Rishonim (The Rosh, quoted in Taz Siman 4:1)  that does not require a Kli for Negel

Vasser. The Rama Siman 4:7 rules that washing without a Kli does not invalidate the Negel vasser

 

However, the Shulchan Aruch Siman 4:7 strongly suggests to indeed  wash with a Kli.  (Psak of the Rashba quoted in the Bais Yosef Siman 4 Dibur HaMaschil U'Mashma. See also Aruch HaShulchan Siman 4:7 where he quotes the Zohar that requires a Kli for Negel Vasser, and stresses the danger that will be present if a Kli isn't used.)

 

The Mishna Berura (Siman 4:16 and 17) writes on the Rama above that L'Chatchila Negel Vasser must be washed with a utensil, as if it isn't washed with a utensil the Ruach Ra is not lifted from the person's body. If for whatever reason the hands were not washed with a Kli, they must be rewashed as soon as possible inthe correct manner, with a Kli (Mishna Berura Siman 4:25 and 26)

 

Incidentally, the Kitzur Shulchan Aruch (Siman 2:1) clearly states that a utensil is required for Negel Vasser.

 

Bottom line: If a utensil is available, it should be used. Even if it isn't available, the hands should be washed under the faucet, opening and closing the faucet each time, alternating the hand,  until each hand was washed at least 3 times. And as soon as a utensil becomes available, the hands should be rewashed again with a proper Negel Vasser.

1)We mentioned yesterday that one who was ill with a [serious] sickness must recite Birchas HaGomel upon being totally healed.

 

There is a dispute amongst the Poskim as to what is considered a "sickness" in regard to this:

 

The Shulchan Aruch (Siman 219:8) rules that upon recovering from any sickness, even one that was not life threatening, the Birchas HaGomel is recited. 

 

 

According to the Rama (ibid.) only upon recovering from a serious [i.e. life threatening] illness would the Bracha be recited.

 

The Mishna Berura (219:28) rules that  a) if one became ill with an illness  that effects the entire body, to the point that we would allow a non Jew to desecrate the Shabbos to obtain a cure, even if it isn't life threatening or b) one became ill [with a non life threatening illness]to the point that they needed  bed rest for three days,  (or with a life threatening illness which required bed rest for even a shorter period of time) then the Birchas HaGomel would be recited upon being cured. (See Biur Halacha Siman 219 Dibur Hamaschil Kegon Maka for more about the three day requirement)

 

2)  The prevalent custom today's days is not to recite Birchas HaGomel after being healed from common illnesses such as  Flus, Cellulitis, infections etc. even if it was accompanied by a high fever and required 3 days of bed rest.

 

 Perhaps the reason for this is that  with the many medical advances in today's world (for which of course we must thank Hashem) these common illnesses are highly treatable and seldom lead to life threatening situations, and thus are no longer considered illnesses that require the Birchas HaGomel. (See Ben Ish Chai Parshas Eikev Siman 67. Based on his ruling there, perhaps even on the Flu etc. it should be recited without Shem U'Malchus.  For Halacha L'ma'aseh, of course, a Rav must be consulted. See also Ohr L'Tzion Perek 14:44)

Reader's Question:

 

If one forgot to say Ya'ale Veyavoh at Mincha on Rosh Chodesh and only realized after shkiya, does he have to do a Tashlumim (make up) Shmone Esrei at Maariv? 

 

If yes, does it make a difference if the next day is no longer Rosh Chodesh?

 
 
 

Answer:

 

Yes, a Tashlumin is necessary at Maariv.

 

If it is Rosh Chodesh, the Tashlumin of course will be with Ya'aleh V'Yavo.

 

If it is no longer Rosh Chodesh at Ma'ariv, it is a machlokes HaPoskim.

 

Some Poskim say that if you daven your Tashlumin without Ya'aleh V'Yavo, then you defeated your purpose, so there is no point of davening again, as you are missing a Ya'aleh V'yavo from Mincha, and you are still missing it after the Tashlumin.

 

Others say that by missing Ya'aleh V'yavo in your Mincha Shemona Esrei, you were not Yotzei your Shemona Esrei at all, so the Tashlumin is necessary for your Shemona Esrei and not just for the Ya'aleh V'Yavo, so of course by doing a Tashlumin, you make up for a missing Shemona Esrei.

 

So, what should be done?

 

The Poskim say that the best thing to do is to indeed daven two Shemona Esrei by Ma'ariv, and a T'nai (stipulation) should be made before starting the second Shemona Esrei, as follows:

 

"If I am obligated in this Tefilah, it should satisfy my obligation. If I am not obligated in this Shemona Esrei, let it be considered a Tefilas Nedava (not a mandatory Tefilah, similar to a Korban Nedava which was not obligatory)"

 

 

If Ya'aleh V'Yavo was mistakenly  recited in the Shemona Esrei of Tashlumin, when it was no longer Rosh Chodesh, it isn't considered a Hefsek.

 

If this happens when Rosh Chodesh is on Friday, it will not work, as we may not daven Tefilas Nedava on Shabbos. (If it does happen on Friday night, either have Kavana  when the Chazan says the Bracha of M'Ein Sheva, or even better, daven for the Amud, if possible,  and by saying the M'Ein Sheva it will be your Tashlumin)

 

The above applies every time one has a real safek if he is obligated in davening a Shemona Esrei, that it be done with this stipulation.

1) One who was ill with a [serious] sickness (we shall discuss the definition of "serious" tomorrow B'Ezras Hashem), or underwent a surgery [on an internal organ], must recite Birchas HaGomel upon being totally healed. (See Shu"t Tzitz Eliezer Vol. 12 Siman 18 and Halichos Shlomo Perek 23:2 regarding an internal procedure that isn't considered life threatening today, such as  inserting stents and balloons and eye surgeries,  that they still require Birchas HaGomel due to their being internal. See also Orchos Rabbeinu from the Steipler page 91 where he questions whether an operation to fix a broken bone requires Birchas HaGomel upon healing.)

 

A Jewish male who was not circumcised as a child, and undergoes a Bris Milah when he gets older, recites Birchas HaGomel upon being healed. (See Shu"t Minchas Shlomo Vol. 2 Siman 4:31 and Shu"t Tzitz Eliezer Vol. 19 Siman 53)

 

 

2) If one was only partially healed, or even mostly healed, no Birchas HaGomel is recited until the healing is totally complete. (Mishna Berura Siman 219:1)

 

 Likewise, if one's sickness is in remission, but according to the doctors may possibly return, no Birchas HaGomel is recited until a totally clean bill of health is received. (See Kaf HaChaim 219:43. This seems to be evident from the Mishna Berura 219:25 as well. See also Shu"t Shevet Haleivi Vol.  4 Siman 152:3 and Shu"t Divrei Yatziv Siman 86)

I saw that the Mishna Berura says to make a [new Bracha of Al ] Netilas Yadayim if one used the restroom for Gedolim or left the premises in the middle of a meal. Is this how we pasken because I've  never heard of this or seen anyone actually do it?
 
 
 

Answer:
 
 
The Mishna Berura Siman 164:3 and Siman 170: 3 and 6  does indeed rule that one who  went to the bathroom for Gedolim during the Seudah does need to rewash with a new Bracha. (if additional bread will be eaten in that meal) 
 
See also the Biur Halacha Dibur Hamaschil Lachzor  V'Litol. The Chazon ish Orach Chaim Siman 25:9 also rules that a new Bracha is required
 
The  Shulchan Aruch HaRav 164:2 maintains that a new Bracha is never needed if there was no Hesech HaDa'as, just a new washing. This is also the Psak of the Pri Megadim (Aishel Avraham) Siman 170:2, Kitzur shulchan Aruch Siman 40:16, Ben ish Chai Parshas b'Haalosecha Siman 68, Kaf haChaim 164:16 and other Poskim.
 
The prevalent minhag, due to Safek Brachos L'Hakel is to require a new washing but not a new Bracha.

1) If one was in danger and was saved by means of an unnatural method (Nes Gamur), besides for reciting the Birchas HaGomel, the Bracha of "Baruch She'Asah Li Nes B'Makom HaZeh- Blessed is the One that performed for me a miracle in this spot" is recited the first time he/she returns to the spot where he/she was saved and then again each time that place is passed, provided that 30 days has passed. (We shall discuss more details of this Bracha in the near future B'Ezras Hashem) (See Sha'ar HaTzion 218:6. See also Mishna Berura 218:31 that Birchas HaGomel does not require an unnatural method of being saved)

 

If one was in various situations of danger and was saved from all of them,  only one Birchas HaGomel is recited for all of them. (Mishna Berura Siman 219:3)

 

2) If a few people in the congregation are obligated in Birchas HaGomel (common during Bain Hazemanim, when a lot of Bachurim come home from studying overseas, or if Chas V'Shalom a few people were in an accident and all survived), each one can recite their own Birchas HaGomel. This is in fact the prevalent custom.

 

However, if one wants to be exempted by another's Bracha, he may do so. (See Shulchan Aruch Siman 219:5. See also Halichos Shlomo Perek 23 footnote 26 that doing so gives it the status of B'Rov Am Hadras Melech. See also Shu"t Tzitz Eliezer Vol.  10 Siman 10)

 

If one is being exempted by another's Birchas HaGomel, he ideally should be standing near the one reciting the Bracha. (Halichos Shlomo ibid.)

Chacham Ovadia Yosef Shlita  holds that when one leaves the restroom and wishes to eat bread, he has 2 choices:
 
1) wash 6 times alternating, say netilas yadayim, asher yatzar, hamotzi
 
or 2) wash 6 times alternating, say netilas yadayim, hamotzi, asher yatzar. he says not to follow the Ben Ish Chai who suggests washing 6 times, saying asher yatzar and then touching an unclean part of the body requiring a regular netilas yadayim for bread because this is forcing a bracha she'eina tzricha.

Regarding one who uses the restroom and also plans to eat bread, there are many different methods that are halachically acceptable. See Shulchan Aruch Siman 165:1 and Mishna Berura S"K 2.
 
The most commonly  accepted method (for Ashkenazim at least )  is to wash the hands without a utensil and recite Asher Yatzar and then wash the hands with a utensil and then recite Al Netilas Yadayim
 Our holy sages, the Chazal tell us  
  תנא דבי אליהו כל השונה הלכות בכל יום מובטח לו שהוא בן עולם הבא, שנאמר הליכות עולם לו, אל תקרי הליכות אלא הלכות
- one who studies [at least two] Halachos daily is assured a portion in Olam Haba -  the world to come.

1)Those who hear someone recite Birchas HaGomel should answer Amen, and then say " Mi SheGmalcha Kol Tov, Hu Yigmalcha Kol Tov Selah-  May He who bestowed goodness upon you continue to bestow every goodness upon you forever" (Shulchan Aruch  219:4 and 5. See also Elya Rabbah Siman 141:6 and Aruch HaShulchan 219:5.)

 

For some reason the prevalent Minhag when hearing this Bracha is to skip the "Amen" and immediately respond with "Mi SheGmalcha..."  (See Shu"t Hisorerus Teshuva Siman 99 where he tries to find an acceptable defense (Limud Zechus) for this minhag, but says that L'Chatchilah it should definitely be answered, no different than any other  Bracha.)  

 

2) Some have the custom, after reciting this Bracha, to recite the chapter of "Mizmor L'Sodah" (Tehillim Perek 100) as this chapter was recited in the Bais HaMikdash whenever someone brought a Korban Todah, the sacrifice of thanks brought after being delivered from danger. (See Chayei Adam Klal 65:4 quoting the Shl"ah HaKadosh. See also Shu"t Teshuvos V'Hanhagos Vol. 1 Siman 195)

 

Some people have the custom to make a Seudas Hoda'ah (a feast of thanks) after being obligated to recite the Bracha of Hoda'ah. (See Shu"t Mishneh Halachos, Tinyana, Siman 175)

[Regarding Q&A # 394 here, where you wrote that after using the restroom when the hands are washed, no utensil is required], the Mishna Berura does bring down an opinion that washing 6 times is necessary after using the restroom and says the Magen Avraham seems to contradict himself.
 
Rav ovadia Yosef shlita holds that the minhag has become to wash 6 times when leaving the restroom and there are many others (ashkenazi and sefardi) who also feel this is proper, necessary to get rid of the Ruach Ra.
 
 

Answer:
 
1) Yes, the Mishna Berura (Siman 4:39) mentions such a stringent opinion that requires washing 3 times each hand after using the bathroom. However, you are correct that he brings the Magen Avraham who argues with that opinion , and indeed it seems that the Mishna Berura concurs that it isnt necessary. See also Sha"arei teshuva Siman 4:12 where he rules that no utensil, and no three times is necessary after the bathroom.
 
Moreover. the Elya Rabba Siman 4:12 writes that even the stringent opinions that require 3 times after the bathroom, agree that no utensil is necessary for those three times! 
 
Another proof to this is brought  by the Poskim from the language of the Shulchan Aruch Yoreh Deah Siman 376:4 where he requires washing the hands after being in a cemetery (which is the same Tumah status as after using the bathroom) where he writes "Rochtzim" and not "Notlim", the language used for netilas Yadayimm  which would seem to mean him not requiring a utensil. The only reason that the custom developed to use a utensil after the cemetery was due to the restriction on dipping the hands into the river. (See Gilyon MaHarsha on the above Shulchan Aruch and see Kitzur Shulchan Aruch Siman 199:10.)
 
Yes, many people were/are stringent to use a utensil, but it is a Chumra (stringency) and NOT M'Ikar D'Din ( see Shu"t Minchas Yitzchok Vol. 5 Siman 96. See also Shu"t Yad HaLeivi where  he rules that only after  using a bathroom belonging to non Jews is a utensil required, but that is due to a danger and not M'Ikar D'Din. See also Biur haGra to Shulchan Aruch Siman 4:18 where he clearly states that this washing is  not M'Ikar D'din and is due to the danger)
 
Bottom line, although there are indeed such opinions, most contemporary Pokim do not rule that way. They just say that as a Chumra, if one wants to do it he can, but they do not require it. I myself have seen many Talmidei Chachomim and Poskim who were not stringent to use a utensil after using the bathroom.

  תנא דבי אליהו כל השונה הלכות בכל יום מובטח לו שהוא בן עולם הבא, שנאמר הליכות עולם לו, אל תקרי הליכות אלא הלכות

We will now, B'Ezras Hashem,  begin learning a new topic: Hilchos Birchos HaHoda'ah, blessings of thanks to Hashem Yisborach.

 

 

1 )The Rambam (Hilchos Brachos Perek 10:26) writes: "...A person should  give thanks for the[the good things that happened to him in the] past, and praise [Hashem] as much as his strength allows, and one who  abundantly thanks and praises Hashem always, is praiseworthy"

 

This is an idea that we find in countless Pesukim throughout Tanach, such as in Tehillim Perek 34 where Dovid HaMelech says "Avarcha Es Hashem B'Chol Eis, Tamid TeHilaso B'Fi- I shall bless Hashem at all times; His praise shall be in my mouth always"

 

Although, one can and should thank and praise Hashem always in his/her own words, there are certain times and situations that require a special Bracha or Tefilah text with which to do so, as per the direction of our holy Chazal. We shall now endeavor to cover as many of these practical situations as we can.

 

2) A person who was in a dangerous situation (we shall discuss these situations more in detail in the days ahead B'Ezras Hashem), and survived, needs to express his/her thanks to Hashem for being saved by reciting the following Bracha, commonly referred t as "Birchas HaGomel":

 

Baruch Ata Hashem Elokeinu Melech HaOlam HaGomel L'Chayavim Tovos SheGmalani Kol Tov- Blessed are You Hashem,  our G-d,  Master of the World who bestows kindness upon the guilty, for bestowing goodness upon me. (Shulchan Aruch Siman 219:1 and 2. See Mishna Berura S"K 4 where he explains the text to mean that Hashem bestows His infinite kindness even upon those who don't deserve it)

 

This Bracha should L'Chatchilah be recited while standing. (Mishna Berura ibid.)

 Do you know of any Torah sources that recommend: 1) physical exercise as a way of staying in good health. 2) playing sports as a good way to spend one's time?
 

Answer:
 
Excercising, in order to stay healthy is an important part of being a Torah Jew!
 
The Torah specifically dictates that we  guard our health, as it states V'Nishmartem Meod  L'Nafshoseichem- You shall Guard your health  very much" (Parshas V'Eschanan  Chapter 4:15)
 
Rambam in the 4th chapter of Hilchos Dayos prescribes a whole regimen of healthy eating and excercise, and even guarantees anybody that follows his regimen to a long life, free of sickness!
 
 
Regarding ball playing, if it is being done for excercise, there is absolutely nothing wrong with it (as long as it is done in a  kosher venue, and without any compromising of halacha)
 
If it is being done for reasons other than health, then  some authorities have dubbed it " a waste of time" (See Kaf HaChaim Siman 308:259)
 
Of course, on Shabbos and Yom Tov  it is prohibited to play ball and/or excercise for various reasons. This applies to children who  have reached the age of Chinuch as well. If necessary for health reasons, a Rav must be consulted.

SPECIAL DOUBLE (and larger) PORTION L'KAVOD SHABBOS CHANUKAH
 

Halachos for Erev Shabbos Kodesh

 

1) The sun's cycle is a 28 year cycle. Once every 28 years , always on a Tuesday evening, the sun returns to the exact spot where it was on the day that Hashem created it on "the fourth day of creation".  (The next time this will happen is in  the year  5,797-2037)

 

Since we cannot see the sun at night, we postpone the blessing until the following morning, thus "Birchas HaChama" always takes place on a Wednesday morning.
 

To commemorate this phenomenon, the Bracha of "Baruch Ata Hashem Elokeinu Melech HaOlam Oseh Ma'asei Vereishis" is recited when the sun is seen at that time, along with some other special prayers. (Talmud Brachos 59b, Shulchan Aruch Orach Chaim Siman 229:2)

 
 

The earliest time for this Mitzvah to be performed is after sunrise (Netz Hachama) and only after the entire "ball" of the sun is visible.

 
The latest time for reciting this Bracha is a subject of debate in the Poskim.

 
Some Poskim maintain that you only have until the end of 3 Halachic hours into the day
(same as  Sof Zman Krias Shma. See Shu"t Chasam Sofer Orach Chaim Siman 56 and Mogen Avraham 229:5)


Other Poskim maintain that one can perform this Mitzvah throughout the entirety of the day. (Elya Rabbah 229:2 and others. However, even according to those opinions, L'Chatchilah it should be recited before Chatzos. According to the Mishna Berura 229:8, it may be recited with Hashem's name until Chatzos, and only without Hashem's name after Chatzos)


According to all opinions, it is best to say the Bracha as early as possible and not push it off for no reason until close to the deadline.

 
2) It is best to perform this Mitzvah with a large group, B'Rov Am Hadras Melech, therefore if you will only have a group after Shacharis, according to many Poskim it is best to do it then, rather than doing it alone at Netz HaChama.
(Shu"t Chasam Sofer ibid. and Elya Raba ibid.)


Other Poskim contend that it is better to recite the Bracha immediately upon seeing the sun and not to wait to do it together with a Tzibbur. (Kitzur Shulchan Aruch Siman 60:6 and 7, Kaf HaChaim Siman 229:13 and 14 and others)


The prevalent minhag in many Jewish communities is to daven Shacharis K'Vasikin and then recite the Birchas HaChama together as a Tzibbur.

 

 

Halachos for Shabbos Kodesh

 

 
1)Some Poskim maintain that women may say this Bracha like any other Mitvas Asei SheHazman Grama (such as Lulav, Sukkah etc. and similar to how they say the Bracha over thunder and lightning) where even though they are not obligated, they may do it if they like.(Rav Moshe Feinstein Zatzal ruled this way)

 
Other Poskim maintain that they should not recite the Bracha , rather hear it from a male and answer Amen. Alternately, many Poskim maintain that women can say it without Shem U'Malchus.

 

Rav Shlomo Zalmen Auerbach Zatzal maintained that the custom is for women not to say this blessing. (And ruled as such Halacha L'ma'aseh in 1981. See Halichos Shlomo page 33) 

 
One thing is clear though from the Poskim: even if a woman does want to participate in this Mitzvah and it is her custom to do so, she must not do it at the expense of Hilchos Tznius, and thus should be careful to stand at some distance from the assembled men.

2 )In the event that it is an overcast day and the sun cannot be seen, it is best to wait until a little before midday(Chatzos) and then, if the sun is still not visible, say the Bracha without Hashem's name (Mishna Berura 229:8)


It is best to recite the Birchas HaChama while standing outdoors. (Siddur Ya'avetz). If one is ill or otherwise unable to go outside, the Bracha may be recited indoors, after having seen the sun through an open window.

A FREILICHEN CHANUKAH
   

The Medrashim state that the Greeks sought to annul from the Jewish People the mitzvos of Shabbos, Rosh Chodesh, and Milah. It is noteworthy that the first three letters of the word Chashmonaim are Ches, Shin, Mem, which stand for Shabbos, Chodesh, Milah. Also contained in the word Chashmonaim is the word Shemen, oil.

I was walking in the cold Michigan weather and tried to warm myself up with a Torah thought. The verse from Tehillim (39:4) came to mind where it is said cham libi bikirbi bahagigi sivar eish dibarti bilshoni, my heart grew hot within me, in my contemplations a fire blazed; then I spoke out with my tongue. The words cham libi (90) equal in gematria the word Chanukah (89). Perhaps this alludes to the warmth generated by the Chanukah lights.

DOUBLE Q&A L'KAVOD SHABBOS CHANUKAH

Does a single girl light [Chanukah Menorah] in a dorm if her father is lighting at home? The family is in America and she is in Israel. must she light or is she included in her family?

 

Answer:
 
If she is in Israel and her father in in the USA, she should light by herself in the dorm,
or if she sleeps at a relatives home she should take part in the relative's lighting (by giving them a coin, to become part of their lighting), as being that  her father is in America she isn't considered as being supported by him (Smucha Al Shulchan AviHa) even if he does in fact support her monetarily. (Psak of Rav Nisim karelitz Shlita quoted in Sefer Shalmei Todah, Chanukah, page 181)

Since women were B'Oso HaNes (also part of the miracle) on Chanukah, should they be obligated in saying Hallel ?
 

Answer:
 
This is a huge  Machlokes HaPoskim.
 
From Tosefos (Sukkah 38a Dibur Hamaschil Mi SheHaya) it seems that they are indeed obligated in Halel on Chanukah just like on Pesach, where the reason for it is due to their being part of the Nes.
 
The Rambam, however,  in Hilchos Chanukah Perek 4:14 seems to say that they are not obligated.
 
Rav Shlomo Zalmen Auerbach Zatzal (Shu"t Minchas Shlomo, Tinyana, Siman 58:1) and Rav Yosef Shalom Elyashiv shlita (Kovetz Teshuvos Vol. 3 Siman 105) rule that they are not obligated, as they learn that the Halel on Chanukah is not on the Nes , and the obligation of women to kindle the menorah does not necessarily mean they are obligated in all aspects of Chanukah. See their Teshuvos at length.
 
Rav Shmuel Wosner shlita (Shevet HaLevi Vol. 1:205) and Rav Chaim Kanievsky Shlita (See Sefer Doleh u'mashkeh page238), rule that they are indeed obligated.

1) It is forbidden to gaze at a rainbow for an extended period of time as it is a Siman Klala, a sign of Hashem's wrath that He really wants to destroy the world.
 
Rather if it is seen the Bracha should be recited, and it should not be looked at again. (Based on Talmud Chagiga 16a that one who gazes at a rainbow will go blind, quoted in Mishna Berura 229:5 and Be'er Heitev S"K 2 quoting the Shl"a Hakadosh. See also MaHarsha in Chidushei Agados to the aforementioned Gemara in Chagiga where he writes that gazing at a rainbow is tantamount to gazing at the Holy Shechina's presence and thus just as one who gazes at the Shechina must die, so too one who gazes at any  manifestation of the Shechina is punished with blindness which is likened to death)

 

Furthermore, if one sees a rainbow, he/she should not say to another person "Look, there is a rainbow in the sky!" (Mishna Berura 229:1 quoting the Chayei Adam that doing so violates the principle of "Motzi Dibah Hu Kesil- One who utters bad tidings is a fool" (Mishlei 10:18), a scriptural warning against talking badly about the world)

 

Some Poskim allow telling your friend in a roundabout way   "It is now possible to recite the Bracha on a rainbow". (Sefer Sha'arei Bracha page 479)

 

2) This Bracha is recited for every [new] rainbow that is seen, even if it is less than 30 days between sightings. (Mishna Berura 229:2)

 

Only a rainbow in the sky  is a "sign" and would require a Bracha, and not a rainbow that is formed from the sun's shining on the water and causing a prism effect etc. (such as is visible on Niagara Falls or often times after a rainstorm such "rainbows" are visible on the ground)

 

 Similarly, there is no prohibition to gaze at such a "rainbow" as it isn't considered a rainbow rather something that looks "rainbow like" (See Drashos HaRan, Drush 1 Dibur Hamaschil V'Zeh Hu Inyan HaKeshes where the great Rishon Rabbeinu Nissim  discusses at length the nature of the rainbow and discusses some of the questions as to its origin etc.)

A FREILICHEN CHANUKAH!
 
On Chanukah we spin the dreidel by holding the post on top of the dreidel.  On Purim, we hold the gragger (the noisemaker) by the handle that is beneath it.  The two ways of holding exemplifies the two types of salvation Hashem brings to the Jewish people.
 
On Chanukah we spin the top part of the dreidel, showing that salvation came "from Above" , as stirred by HaShem's compassion.   But on Purim the gragger is held from below, an indication of how Hashem's mercy was aroused "from below".  In the merit of the Jewish people on earth.

If one gets married during  Chanukah, where should he light the Menorah on the night of his wedding?

 

Answer:
 
If the Chuppah will be  at night (after Tzeis HaKochavim) he should light in the same home in which he lit until now, as at the time of the lighting he was not yet married and was still part of that home.

However, if the Chuppah was during the daytime, the Choson and kallah should go to their new apartment and eat a light meal (to establish their residency) and light the menorah in the new apartment and then return to the Chasuna hall for the duration of the wedding. (Psak of Rav Shlomo Zalmen Auerbach Zatzal and YBLC"T Rav Yosef Shalom Elyashiv shlita quoted in Sefer Nisuin K'Hilchasam Perek 15:60 and footnote 130.)

If this is impossible, or difficult (e.g. the Chasan is already in the hall and is unable to go to the new apartment after the Chuppah), a Shliach (messenger) should be appointed to light on his behalf. (Psak of Rav Bentzion Abba Shaul Zatzal, ibid.)

1) After the Mabul (the great flood), Hashem promised to never bring such destruction again upon the world, and instead, whenever the world was deserving of such destruction, a rainbow appears in the sky as a sign. (Parshas Noach Perek 9:11-17)

 

Upon seeing a rainbow in the sky, the following Bracha is recited: Baruch Ata Hashem Elokeinu Melech HaOlam Zocher HaBris, Ne'eman (or V'Ne'eman according to the Rambam and the Tur) B'Vriso V'Kayam B'ma'amaro- Blessed are You Hashem, Our G-d, Master of the world, who remembers the covenant; is trustworthy in His covenant, and fulfills His word [not to destroy the world]. (Shulchan Aruch Siman 229:1 and Mishna Berura S"K 4)

 

2) There is a debate amongst the Poskim if an entire rainbow (i.e. the  full half circle) must be seen in order to be able to recite the Bracha or even seeing part of it suffices, thus if only a small part of a rainbow is seen it is best to recite the Bracha without Shem U'Malchus. (See Biur Halacha Siman 229 Dibur Hamaschil HaRoeh. See also Shu"t Teshuvos V'Hanhagos Vol. 3 Siman 76)

I live in an apartment where the ony  window to light the [Chanukah] Menorah is in the bathroom.
 
May I light at this window? and if so,should I recite the Brachos out of the bathroom and then enter to light or should I recite the Brachos and light out of the bathroom and then move the Menorah to the window?


 

Answer:
 
No, you may not keep the Menorah in the bathroom, as doing so is not Kavod (respectful) to the Mitzvah
 
If you  do not have another window [and can't light at the door], it is better to light inside your home, but definitely not in a bathroom.
 
Incidentally, once the Menorah is lit, it may not be moved to another location.

1)The Bracha on seeing blossoming trees  is only recited on fruit trees, and only when the buds/flowers  are seen in the early stages of blooming, and not on trees  where only leaves are seen and not on trees where the  fruit has already completely developed. (Mishna Berura Siman 226:2 and 4. See also Shu"t Shevet Haleivi Vol. 6 Siman 53:4)
 
If one saw such a tree and did not recite the Bracha, it may be recited at the next opportunity.
(See Mishna Berura Siman 226:5 and Sha'ar HaTzion S"K 3. Some Poskim, including the Kitzur Shulchan Aruch Siman 60:1 and Kaf HaChaim Siman 226:9 and 10, argue and rule that if it wasn't recited upon seeing it the first time, it is no longer recited at all. See also Shu"t Shevet Haleivi Vol. 6 Siman 53:4)
 
2) According to the Sifrei Kabala, reciting this Bracha, is a big Tikkun (spiritual repair) for the Neshamos  that are hovering between the two worlds as Gilgulim (reincarnated souls) in the  barks of trees, and it's important when saying this Bracha to have in mind to bring heavenly mercy onto these hovering souls
and allow them to be freed from their pain and allow them to return to  their place in Olam Haba (See Shu"t Teshuvos V'Hanhagos Vol. 1 end  of Siman 191 and Kaf HaChaim 226:8. The Kaf HaChaim 226:4 goes so far as to give another reason for this Bracha  not being said on Shabbos, as doing so will be "Borer", separating the  "sparks of Kedusha" of the Neshamos from the trees!)

If a woman is in the hospital on Chanukah after giving birth to a child [or for any reason], does she have to light a Menorah in the hospital?

 

Answer:
 
If her husband is lighting the Menorah in their home, she is exempted with that lighting and there is no need for her to light an additional Menorah in the hospital.
 
The same would apply if a man is R"L in the hospital, and his wife lights  the Menorah in their home, he is exempt from lighting  an additional Menorah in the hospital. 
 
If, however, the spouse is not lighting at home (or if there is no spouse) then they must light in the hospital.

(See Mishna Berura Siman  677:2. See also Halichos Shlomo Perek 13:5 where he writes that if possible she should at least hear the Brachos from someone who is lighting in the hospital, based on Mishna Berura 676:6)

1) Some people have the custom after reciting the Bracha on seeing blossoming  trees  to add additional Mizmorim of Tehillim and other texts praising Hashem for the trees.
 
Some people try to say this Bracha with other people, as a group.
 
Some even have the custom to give Tzedaka before reciting this Bracha.
 
Each person should do as their customs dictate.
(See Kaf HaChaim 226:7 and 8. See also Shu"t Minchas Yitzchak Vol. 10 Siman 16)
 
2) This Bracha may only be recited once a year, and according to some Poskim only during the daytime
(Mishna Berura 226:3. See also Shu"t Har Tzvi ibid. and Shu"t Tzitz Eliezer Vol. 12 Siman 20:6)
 
The Bracha on seeing a blossoming tree should
not be recited on Shabbos, as we are worried that  one will touch the tree and/or pluck a branch from it, as well as for Kabalistic reasons (which we will discuss tomorrow B'Ezras Hashem).
 
 However, if it is seen on Shabbos and it will be the last opportunity to recite the Bracha, it may indeed be recited according to many Poskim
(See Kaf HaChaim 226:4 and Shu"t B'Tzel HaChachma Vol. 6 Siman 37. See also Shmiras Shabbos K'Hilchaso Perek 26 footnote 72 and Shu"t Yechaveh Da'as  Vol. 1 Siman 2)

[You wrote in the Halachos for Nov. 24 2008 :]
 
"It is brought in the Sefarim not to pound the heart [by Selach Lanu] on days when Tachanun is not recited. (MeKor Chaim and Siddur Ya'avetz in the name of the Shl"a)"  
 
According to the Shla Hakodesh does thet also apply to times of day when tachanun is not said, for example maariv?
 
and secondly, only on days that are brought down that you do not say tachanun, or anytime a shul does not say it for various reasons?

 

Answer:
 
I looked again in the Siddur of Rav Yaakov Emden (Ya'avetz) who quotes the Shl"a. All he says is a curt  "Chutz m'Yom Sheain Omrim Bo Tachnun- except a day that Tachnun isn't recited"
 
If a specific shul doesnt say Tachnun for a certain reason, but the rest of Klal Yisroel does, I would imagine that is still a "Yom SheOmrim Bo Tachnun", and you would hit your chest by Slach Lanu.
 
As far as the Maariv before, I don't know exactly. Al Pi Sevara, I  am leaning towards saying that one should  do it by the maariv before.
 
If I find more sources for this, I will be sure to let you know.

1) One who sees fruit trees that are beginning to  bloom, in the [beginning of the] month of Nissan, or at any other  time when it's the season for the trees to bloom,  recites the following Bracha: Baruch Ata Hashem Elokeinu Melech  HaOlam Shelo Chisar B'Olamo Klum U'Vara Vo Beriyos Tovos V'Ilanos Tovos (or "Tovim"; See Kitzur Shulchan Aruch Siman 60:1) Lehanos Bahem Bnei Adam- Blessed are You Hashem, Our G-d, Master of the Universe, who ensured that nothing is lacking in His world and Created in it good creations and good trees in order to pleasure mankind with them. (Shulchan Aruch Siman 226:1 and Mishna Berura S"K 1. See Aishel Avraham (Butshatsh) that only in Nissan may the Bracha be recited with Shem U'Malchus. However, the prevalent Minhag is to say the regular Bracha as long as the tree is still in the blooming stage, even if this is past Nissan. See Chayei Adam Klal 63:2 and Aruch HaShulchan 226:1 regarding climates where the blooming season is not in Nissan (e.g. Australia or South Africa). See also Shu"t Har Tzvi Orach Chaim Vol. 1 Siman 118 and Shu"t L'Horos Nosson Vol. 5 Siman 7)
 
2) Preferably this Bracha should be said on two or more trees [in a field]and not on a solitary tree. However, if it was recited on a solitary tree it is acceptable. Reader's Question: 
 
 
Some people in the shul in which I daven do something which I consider very annoying, and I was wondering if you could tell me if what they are doing is proper or not.
 
If something special is to be inserted in Shmoneh Esrei (Such as Al HaNisim or Yaaleh v"Yavoh ), they say the first few words out loud when they reach that point in their silent Shmoneh Esrei.
 
I suppose they're trying to make sure everyone remembers to say it.
 
It disturbs me because first of all it disturbs what little kavanah I usually muster, as I am distracted from the current bracha I am saying to be reminded of something else. Also, it seems that shey should be directing their prayers to Hashem, not signaling others in the middle of their tefillah. I wish they would stop doing it. It really bothers me. 

 

Answer:
 
This is another one of those sticky situations, which are hard to control.
 
Many Poskim do indeed say that if these "shout outs" are being done in order to remind the Tzibbur to say Yaaleh V'Yavo or "V'Sein Tal Umatar" or Al HaNisim etc. then it is OK (See Shu"t Eretz Tzvi Siman 24)
 
The Chazon Ish was of the opinion that doing so is not proper Derech Eretz, and even though the "shouter" has good intentions it should not be done (Dinim V'Hanhagos L'Chazon Ish Perek 4:33; also broght in Orchos Rabeinu from the Steipler Vol. 3 Page 207.)
 
Rav Shlomo Zalmen Auerbach Zatzal also was against this "Minhag"  of every person in Shul doing this, as it is a Bizayon (disgrace) to the King [Hashem].
 
However, he quotes the Magen Avraham ( Siman 114:2)that says that for one person (the Shamash or Gabai) to do so when he reaches that place in Tefilah it's OK, but not the whole shul (Halichos Shlomo  Chapter 8, Ha'arah 20)
 Our holy sages, the Chazal tell us  
  תנא דבי אליהו כל השונה הלכות בכל יום מובטח לו שהוא בן עולם הבא, שנאמר הליכות עולם לו, אל תקרי הליכות אלא הלכות

SPECIAL DOUBLE PORTION L'KAVOD SHABBOS KODESH
 
Halachos for Erev Shabbos Kodesh
 
1) Once the Bracha is recited on Thunder and lightning, the Bracha is not recited again that day, during this storm.
 
If the clouds dissipated totally and the storm was over, and later on that day a new storm arrived, the Brachos can once again be recited.
 
2) If the [same] storm did not let up and continued overnight into the next day, a new Bracha may be recited on thunder and lightning seen/heard once more on the following day.
(Mishna Berura 227:8. See also Kaf HaChaim 227:13 and Halichos Shlomo Perek 23:27 that for this Halacha the next morning is considered a new day, and we don't say that the "day" starts at night like by most other things in Halacha. However, other Poskim, including Rav Yosef Shalom Elyashiv Shlita argue and maintain that the new day for this also starts at sunset. See Sefer Saiser Ram Siman Perek 6:6 where he quotes these opinions at length. See also Shu"t Tzitz Eliezer Vol. 18 Siman 78 and Shu"t Az Nidberu Vol. 5 Siman 32) 
  

 
Halachos for Shabbos Kodesh
 
1) The Brachos on thunder and lightning may only be recited immediately after hearing/seeing them
(Toch K'Dei Dibur, a time span of approximately 3-4 seconds)
 
 If more time elapsed, the Bracha can no longer be recited, and one must wait until the next bolt arrives.
(Mishna Berura 227:12)
 
2) Thus, if one is in an unclean place, where a Bracha may not be recited, when he/she sees or hears thunder/lightning, if they can quickly move out of that place and their hands are clean, then he/she must quickly leave that place and recite the Bracha.
 
If they cannot get out in time, or if the hands aren't clean, no Bracha may be recited on that particular thunder/lightning anymore, and they need to wait for the next bolt.
 
If one exited the restroom, washed his hands and  heard thunder, the Bracha on it should be recited before the Bracha of Asher Yatzar.

Someone recently told me that it is extremely important to give Tzedaka (Charity) on Chanukah. I was surprised to hear this, as I thought Purim was the holiday with the emphasis on  charity. Is there any truth to what he told me?




 

Answer:
 
Yes, It is customary to give extra Tzedaka on the days of Chanukah, especially to support poor people who spend their lives dedicated to learning Torah. (See Kitzur Shulchan Aruch Siman 139:1 and Mishna Berura Siman 670:1 that there are [kabalistic] reasons for this)
 
The Yesod V'Shoresh H'Avodah (Sha'ar 12:1) expounds on this, based on the Zohar Hakadosh and the Kisvei Ha'Arizal, that one who is lax in giving of Tzedakah all year round can rectify the harm this laxity caused by increasing his/her Tzedakah on Chanukah, especially if giving to support those who learn Torah.



 Our holy sages, the Chazal tell us  
  תנא דבי אליהו כל השונה הלכות בכל יום מובטח לו שהוא בן עולם הבא, שנאמר הליכות עולם לו, אל תקרי הליכות אלא הלכות

1) Upon hearing thunder, after having already recited the Bracha on the lightning that preceded it, the following Bracha is recited: "Baruch Ata Hashem Elokeinu Melech HaOlam SheKocho U'Gevuraso Malei Olam- Blessed are you Hashem, Our G-d, Master of the world, Whose Power and Strength Fills the universe".  (See Mishna Berura Siman  227:5-7)
 
If the two  Brachos were confused and Oseh Ma'aseh Vereishis
(* See Note Below)  was recited on thunder and/or SheKocho U'Gevuraso Malei Olam was recited on lightning, it is acceptable and doesn't need to be repeated. ( See Sha'ar HaTzion 227:7)
 
2) If one simultaneously (or successively) saw lightning and heard thunder. Only the Bracha of Oseh Ma'aseh Vereishis should be recited on both.
(Mishna Berura 227:5)
 
If one sees lightning or hears thunder and does not recite the Bracha, the Bracha can still be recited on the next one that is seen or heard.
(See Shu"t Be'er Moshe Vol. 2 Siman 10 and Shu"t Yechaveh Da'as Vol. 2 Siman 27) 
  
 
 * Note:
A daily reader correctly pointed out that the proper Dikduk (grammar) for this Bracha dictates that the last word of this Bracha be pronounced "...Oseh Ma'aseh Vereishis"  (with a soft Veis), and not Bereishis (with a hard Beis), so from here forward I will indeed use the grammatically correct form.

May an avel (mourner) for a parent, during sheloshim, sing Ma'oz Tzur and HaNeiros Hallalu after lighting Chanukah candles? If not, should Ma'oz Tzur be said?




 

Answer:
 
Yes, as long as no music is present, there is no problem with an Avel singing these Zemiros or any other Zemiros for that matter. He shouldn't dance.

1)Upon seeing/feeling uncommonly strong winds, on feeling an earthquake, upon seeing a shooting star or a Meteoroid the Bracha of "Baruch Ata Hashem Elokeinu Melech HaOlam Oseh Ma'aseh Bereishis" is recited.  (See Mishna Berura Siman 227:4)
 
2) Upon seeing lightning [that is part of a rainstorm, as opposed to lightning that happens in a heat storm] the following Bracha is recited: "Baruch Ata Hashem Elokeinu Melech HaOlam Oseh Ma'aseh Bereishis".
(Shulchan Aruch Siman 227 and Mishna Berura S"K 3.  See Shu"t Shevet Haleivi Vol. 10 Siman 48 for more about lightning during heat storms.)
 
The actual lightning bolt needn't be seen, even if the light produced by the bolt is seen it suffices to necessitate the recital of the Bracha. 
 
Likewise, if one is in a dark room and sees the room get illuminated due to the lightning, even if no actual part of the bolt was seen, a Bracha can be recited.  However, if one didn't see anything and was just informed that there is lightning, no Bracha is recited. (See Shu"t Tzitz Eliezer Vol. 12 Siman 21, Shu"t Minchas Shlomo Vol. 2 Siman 4:34 and Shu"t Az Nidberu Vol. 10 Siman 23)

Firstly, regarding "Al Hanisim" in middle of birkas hamazon- whats that small tefillah that one puts in in case he forgets to say it and reminds himself before "Harachamon"?
 
Second  of all, just last night, after candle lighting,I decided that instead of just wasting my time by the candles with shmoozing, i will use my precious time to say "Perek Shira" As i was in middle of saying it, some of my family members claimed that one is not permitted to say it at night, since it entails lots of pesukim from Tehillim.
 
I always knew that Perek Shira one can say any hour of the day/ night. is that not correct?
 
Also, if you can provide any insight as to why one cannot say Tehillim at night I would greatly appreciate it.





 

Answer:
 
 
1) The accepted Nusach to say is "HaRachaman Hu Yaaseh Lanu nisim V'Niflaos K'mo SheAsisa L'Avoseinu Bayamin Hahem BaZman HaZeh. BiMei MaTisyahu...." (see Bais Yosef Siman 187 and Siman 682. See also Ram'a Siman 187:4 for a slightly different Nusach)
 
2) I commend you for spending the time after Hadlokas neiros doing something meaningful. The subject of saying Tehilim/ pesukim at night is a fascinatiing one, and there are many different opinions about this. If Tehilim is prohibited at night, it would only because of its status as "Torah Sh'Biksav", and not intrinsically because it is Tehilim.
 
 I will list a few of the many Mekoros for this:
 
*The Be'er Heitev on Orach Chaim Siman 238 quotes the Arizal who says that one shouldn't study "Mikrah- Torah sheBiksav" by night.  The Seforim say that the aforementioned Arizal does not apply to Thursday Night/Friday mornings.
 
* The reason for this is obviously Kabalistic (See the Artzos HaChaim (Malbim) Siman 1:36. See also Yesod V'Shoresh H'Avodah Sha'ar 6;HaNitzutz Perek 2 ) .
 
* In Shu"t Cham Sha'al Vol. 2 Siman 25 he quotes the great Mekubal Rav Shalom Sharabi (Rashash) who maintained that Tehilim was excluded from the above prohibition, and may be said at night. In fact, he says that Dovid Hamelech composed and wrote the Tehilim at night! (Another reason is because Hashem gave Tehilim a status  like "NeGaim and AHalos", which basically  gives it a status of "Torah Sh'Ba'al Peh", which is permitted anytime.)
 
* If the Tehilim is being said for the Refuah Shelaima of a Choleh it can surely be said at night. (Psak of Debreciner Rav in Be'er Moshe Vol. 4 Siman 22, Eishel Avraham (Butchatch) Orach Chaim Siman 306, and other Poskim)
 
* If the Pesukim are learned with a Pirush (commentary such as Rashi) then it is not a problem at all and has a status like oral Torah, which of course can be learned at night. (Shu't Levushei Mordechai Siman 186 and others)
 
Perek Shirah would be OK to say at night  for two reasons: 1) Most of the Pesukim are indeed from Tehillim, which we learned is permitted. 2) The Perek Shirah in its entirety is a "Beraisa" which teacheds us which Pesukim each part of creation recites in praise to Hashem, so in essence it probably has a status of "Torah Sh'Ba'al Peh", no different than learning a Gemara that quotes Pesukim in it..

1) Upon seeing beautiful trees, fields,   an exceptionally beautiful person [, male or female,] or a beautiful animal the following Bracha is recited: Baruch Shekacha Lo B'Olamo- Blessed is the One Who has such [creations] in His world" (Shulchan Aruch Siman 225:10)
 
According to some Poskim this Bracha is no longer recited today's days, therefore it is best to recite this Bracha  without Shem U'Malchus. (See Chayei Adam Klal 63:1, Mishna Berura 225:32 and Sha'ar HaTzion 225:33 where he writes the reason as it being very hard today's days to determine which creatures are extraordinarily  more beautiful than others.)
 
This Bracha is never recited again, unless a more beautiful variety than the original sighting is seen. (Shulchan Aruch ibid.)
 
2) If the beautiful person seen is a non Jew (we are possibly referring here only to an idol worshipper, according to many Poskim), he/she may be looked at quickly and the Bracha recited, but one may not gaze and marvel at the beauty of an idol worshipper as doing so is a transgression of the biblical prohibition of "Lo Tichanem" (Devarim 7:2). 
 
Incidentally, it is prohibited to verbally say about an idol worshipper that they are good looking or another compliment, due to the above transgression. (See Mishna Berura 225:33 quoting the Mogen Avraham based on the Talmud Avoda Zara 20a. See Sefer HaChinuch Mitzvah 426 and 427 and Minchas Chinuch there for a full treatment of the dos and don'ts in dealing with idol worshippers.  There are exceptions to these rules, if for reasons of peace (Darchei Shalom) or for reasons benefitting the Jew. Also, it is debatable if these Halachos apply to all non Jews or just to idol worshippers, which aren't common today. The Bais Yosef Choshen Mishpat end of Siman 249 clearly states that these Halachos apply to all Non Jews, including Arabs, and not just to idol worshippers. The Rambam and other Rishonim seem to hold that this applies only to idol worshippers. 
See Radak to Melachim I Perek 11:2. See also  Shu"t Tzitz Eliezer Vol. 15 Siman 47. There is a lot more to write about this topic, but this isn't the proper time or place for it. For Halacha L'ma'aseh a Rav should be consulted.)
 
If the beautiful person is a female, a male may only recite the Bracha if he happened to see her, but he may not purposely look at her (or any other female) and surely it is prohibited to gaze or otherwise look at her for her beauty beyond the first chance glance. (See Biur Halacha Siman 225 Dibur Hamaschil Afilu. See also Mishna Berura Siman 75:7 regarding the strict prohibition of men looking at women)

You mentioned that Al Hanisim is to be recited in the Birchas Hamazon[ on Chanukah], why not in the Al HaMichya [M'ein Shalosh] that is recited after cake, wine and such?
 
  We insert for all other special days Shabbos, Rosh Chodesh, Yom Tov, but not Chanukah or Purim [ Al Hanisim ].  Why?



 

Answer:
 
 
Because we don't mention Hod'aah (Thanks) at all  in Al HaMichya, thus there is no place for us to insert Al Hanisim, which is an addendum of Hoda'ah and not simply a Hazkarah (Mentioning) of the Yom.

1) One who sees an elephant or a monkey for the first time, also recites the Bracha of Baruch Ata Hashem Elokeinu Melech HaOlam Meshaneh HaBriyos.  (Shulchan Aruch Siman 225:8)
 
 The reason these 2 animals are singled out for this Bracha, when apparently all animals in the animal kingdom have their own unique and often strange appearance, is as follows:
 
The Talmud (Sanhedrin 109a) tells us that one of the punishments that Hashem meted out to the Dor haflaga ,The people who tried to build the tower to heaven and wage war on Hashem,was to turn them into monkeys. (Unlike the evolutionists who absurdly believe that mankind evolved from monkeys, Chazal tell us that in fact the opposite is true and monkeys actually evolved from man!)
 
Thus, according to this Gemara, monkeys were not created  during the 6 days of creation, and were only "changed" from humans as a punishment. Thus the Bracha of "Meshane HaBriyos- Changes the creatures" is perfectly understandable! (See Maleches Shlomo to Mishna in K'layim Perek 8:6  Dibur Hamaschil Hapil V'HaKof where he alludes to the above and also adds that elephants understand  the language of man, and thus are "different" and require  this Bracha. 2) Today's days, with the advent of pictures and  the abundance of zoos, there is hardly anyone that hasn't seen a monkey or an elephant  from when they were a small child, so  on a practical level this Bracha does not ever get said. (Based on Mishna Berura 225:29)

You mentioned (See Archives Hilchos Chanukah Here, halachos for  Dec. 19 2008 where we discussed the Issur of playing Kvitlach)  that "Kvitlach" is unfortunately prevalent in today's times, and that it is a "minhag" that is improper and bottom line leads to a situation of moshav leitzim.
 
First of all, is it really something that is common these days that the Biur Halacha and Aruch Hashulchan felt the need to mention its severity?!
 
Besides, where would the heter even be found for such a "minhag" to allow it to take place to begin with (how did something like this start anyway)?
 
Also, I learned somewhere (don't remember where) that playing Dreidel (even with money) is a minhag that is acceptable and even advocated for?
 
If that's the case, can you please explain why one is allowed and the other isn't?
 
I take it the nafka mina would be the actual cards... ?

I am happy to hear that in your circles it isn't a prevalent minhag!
 
But unfortunately in many circles (I will not identify any specific communities, neighborhoods or sects) it is quite common to have these "games". I have witnessed these games and been invited to them on more than one occasion (though, after a while of turning down these "invitations" they stopped coming Baruch Hashem)
 
Dreidel, on the other hand is an acceptable game (And its origin has sources in Sefarim HaKedoshim as Minhag Yisroel. See Taamei HaMinhagim Os 859) as long as the "pot" of money is designated to belong to everyone, and thus it wouldn't be gambling, and also no real money is at risk. The Chasam Sofer was known to play dreidel on Chanukah and it is the Minhag of various Chasidic Rebbes to do so as well. (See Piskei Teshuvos Siman 670:4 for more on this topic)


 Our holy sages, the Chazal tell us  
  תנא דבי אליהו כל השונה הלכות בכל יום מובטח לו שהוא בן עולם הבא, שנאמר הליכות עולם לו, אל תקרי הליכות אלא הלכות
- one who studies [at least two] Halachos daily is assured a portion in Olam Haba -  the world to come.

1) Uon seeing a person whose outward appearance is extremely strange,  unusual or  atypical [and it is this way from birth] the following Bracha is recited: Baruch Ata Hashem Elokeinu Melech HaOlam Meshaneh HaBriyos- Blessed are You Hashem, our G-d, Master of the world, who creates the creatures Different" (Shulchan Aruch Siman 225:8 and 9)
 
This Bracha is never recited again upon seeing the same or different person with similar abnormal features
.(Psak of the Mishna Berura Siman 225:29. See  Aruch HaShulchan Siman 225:13 for a different opinion on this and see  Shu"t Tzitz Eliezer Vol.  12 Siman 22)
 
A few of the many  examples of this would include people with odd skin complexions (such as albinos or red skinned), midgets and dwarfs, extreme hunchbacks, people born without all their limbs, etc.
 
Of course, if any of these have become commonplace sights in society, no longer may this Bracha be recited.
(See Mishna Berura Siman 225:24 and Kaf HaChaim 225:50)
 
2) If the strange appearance is not from birth and only developed later on in life (either naturally or from an occurrence), if  the person is Jewish and you feel  bad for them  and are pained at his having to look that way, the  proper Bracha to recite is "Baruch Dayan HaEmes"
(as we assume this was brought about by a heavenly chastisement. See Mishna Berura Siman 225:26)
 
If , however, you aren't pained at the sight of the abnormality that developed after birth, or upon seeing a non Jew with any of the above abnormalities [that developed after birth], no Bracha is recited. (Mishna Berura 225:28)

Does a person have to stay with the lit Chanukah candles for the full half hour?
 
For example, to rush and make an appointment one will have to leave the neiros alone?



 

Answer:
 
 
Yes. Ideally one should stay for half an hour in the room with the candles, or at least stay home wih them. It is best not to light them and immediately run out to an appointment etc. (Besides the danger involved in leaving candles burning in an empty home).
 
If there are other people  who stay in the home and one person  is running out, though not ideal, it is better.

 SPECIAL DOUBLE PORTION L'KAVOD SHABBOS KODESH
 
 
Halachos for Erev Shabbos Kodesh
 
1) One who sees 600,000 Jews in one gathering recites the Bracha
 "ברוך אתה ד' אלקנו מלך העולם חכם הרזים - Blessed are You Hashem, Our G-d, Master of the world, Knower of Secrets" (
Shulchan Aruch Siman 224:5)
 
The meaning of this Bracha is as follows: No two people are the same, their faces are different, their thoughts are different, yet Hashem is all knowing and knows the deepest thoughts of each and every one of us! Thus, when we see 600,000 Jews, we basically see the entire jewish nation (as the number used to refer to the Jewish nation as a whole is always 600,000, as that was the amount of Jews  [men, between the ages of 20 and 60] who left Egypt and received the Torah) and thus an opportune time to praise Hashem for being all knowing and all seeing.
(See Mishna Berura Siman 224:8)
 
2) Some Poskim maintain that only in Eretz Yisroel is this Bracha recited, and upon seeing 600,000 Jews anywhere besides for in Eretz Yisroel, the Bracha is recited without Shem U'malchus.
(See Kaf HaChaim 224:15)
 
Halachos for Shabbos Kodesh
 
1)  Upon seeing 2 or more Jewish Graves, once every 30 days, the following Bracha is recited:
 
ברוך אתה ד' אלקנו מלך העולם אשר יצר אתכם בדין וזן וכלכל אתכם בדין והחיה אתכם בדין ויודע מספר כולכם בדין ועתיד להחזיר  ולהחיותכם בדין ברוך אתה ד' מחיה המתים
 
Blessed are you Hashem, our G-d, Master of the World, who created you with Justice, sustained you with Justice, gave you life with Justice, He has an accurate account of each and every one of you[r actions] with Justice, He will eventually  return you and make you live again with Justice, Blessed are You Hashem, who makes the dead live again
.(Shulchan Aruch Siman 224:12 and Mishna Berura S"K 16)
 
2 ) L'Chatchilah, this Bracha should be recited when within four Amos of the graves, however  B'dieved if it was said from afar it's acceptable and indeed Kohanim, who may not go within 4 Amos of a grave, say it from afar.

On Shabbos Chanuka, I will be in a hotel for a Simcha from Friday afternoon until  Motzai Shabbos. What is the Halacha  for lighting Chanuka candles  Friday evening?



 

Answer:
 
 
One who is not home, and is spending the night in a hotel must light in the hotel.
 
According to many Poskim the ideal place is in the room in the hotel that you will be sleeping in and not  in the dining room, as this room is "reserved" for you. (Psak of Rav Yosef Shalom Elyashiv Shlita. Rav Moshe Sternbuch Shlita in Shu"t Teshuvos V'Hanhagos Vol. 3 Siman 215:14 paskens like this as well, besides if there is no window in the room, then he maintains it's better to light at the window in the dining room)
 
Some Poskim (Rav Nissim Karelitz Shlita and others) maintain that it is best to light in the dining room, especially if there are others there for the same reason as you (family simcha, Yarchei Kallah etc.)  as that makes it as if the entire "family" is together, and thus the proper place to light.
 
Obviously, if the hotel doesnt allow  lighting fires in the rooms, it is best to rely on those Poskim that  say to light in the dining room.
